These Terms of Use ("Terms") govern your access to and use of Mooncrack Tap to Earn ("App"), operated by Mooncrack.io ("Company," "we," "our," or "us"). By accessing or using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must discontinue using the App immediately.
1. General Provisions
1.1. Binding Agreement
1.1.1. These Terms constitute a legally binding agreement between you ("User," "you") and the Company ("we," "us," "our"). By accessing, using, or registering for the App, you confirm that you have read, understood, and agreed to these Terms in their entirety.
1.1.2. If you do not accept these Terms in full, you must immediately cease using the App, delete any associated accounts, and refrain from accessing the App or its services in the future.
1.1.3. The failure to read or review these Terms does not absolve you of your obligations under them, nor does it imply non-acceptance or provide grounds for exemption.
1.1.4. You represent and warrant that:
- You are legally capable of entering into a binding agreement.
- Your use of the App complies with all applicable laws and regulations in your jurisdiction.
- You will not access the App if prohibited by law or if you do not meet the eligibility requirements set forth in Section 2.
1.1.5. This agreement is effective immediately upon your first access, registration, or use of the App, and it will remain in effect until terminated in accordance with these Terms.
1.2. Modifications to the App and Terms
1.2.1. The Company reserves the right, at its sole discretion and without prior notice, to modify, update, suspend, or discontinue any aspect of the App or these Terms, including but not limited to:
- Features, functionalities, and services.
- The points system, reward structures, or conditions for earning or redeeming rewards.
- User access to the App, whether for specific users, geographic areas, or devices.
- These Terms, the Privacy Policy, or other related policies.
1.2.2. Any modifications to these Terms or the App will take effect immediately upon posting within the App or notification via email, push notification, or other communication methods deemed appropriate by the Company.
1.2.3. Users are responsible for regularly reviewing these Terms and any associated policies for updates. The date of the latest revision will be clearly indicated. Continued use of the App after changes are made constitutes acceptance of the updated Terms.
1.2.4. In jurisdictions where explicit acceptance of Terms modifications is required, the Company may implement a mechanism (e.g., requiring users to accept updated Terms before proceeding) to ensure compliance.
1.2.5. The Company is not liable for any damages, loss of points, rewards, access, or user dissatisfaction resulting from modifications, updates, suspension, or discontinuation of any part of the App.
1.2.6. If a user objects to any changes, their sole remedy is to discontinue use of the App and delete their account.
1.3. Jurisdiction and Compliance
1.3.1. These Terms are governed by and construed in accordance with the laws of the European Union (EU) and the United States (US), excluding conflict-of-law principles that might apply the laws of another jurisdiction.
1.3.2. Users are solely responsible for ensuring that their access to and use of the App complies with all applicable laws and regulations in their jurisdiction, including but not limited to restrictions on cryptocurrency transactions, online gaming, taxation, and data collection.
1.3.3. The Company reserves the right, at its sole discretion, to restrict, suspend, or terminate access to the App in jurisdictions where its operation may conflict with local laws or regulations. This may include:
- Implementing geo-blocking or other technical measures.
- Prohibiting users from specific jurisdictions from registering or using the App.
1.3.4. The Company is not obligated to notify users of jurisdictional restrictions or to provide individualized guidance regarding legal compliance.
1.3.5. In the event of legal disputes, Users agree that:
- Disputes will be resolved exclusively in accordance with the governing laws specified in this section.
- Jurisdiction-specific consumer protection or other mandatory provisions may apply only to the extent required by law.
- Users may be required to submit to arbitration, as outlined in Section 12 (Governing Law and Dispute Resolution).
1.3.6. If any provision of these Terms is deemed unenforceable in a specific jurisdiction, the remaining provisions shall remain in full force and effect.
2. Eligibility
2.1. Age Requirement
2.1.1. Users must be at least 18 years old or the age of majority in their jurisdiction, whichever is higher, to register for and use the App. By accessing or using the App, you represent and warrant that you meet this age requirement.
2.1.2. The Company reserves the right to implement mandatory age verification procedures at any time, including but not limited to:
- Requiring submission of government-issued identification.
- Cross-referencing with third-party age verification services.
2.1.3. Accounts created or operated by individuals who do not meet the age requirement will be:
- Immediately suspended or terminated.
- Subject to permanent forfeiture of accumulated points, rewards, or other in-app assets.
2.1.4. The Company assumes no liability for underage users accessing the App through false information or bypassing verification systems. Users are solely responsible for ensuring compliance with this requirement.
2.2. Account Creation and Maintenance
2.2.1. Each user is permitted to create and maintain only one account. The following are strictly prohibited:
- Creating multiple accounts for personal use.
- Sharing accounts between multiple individuals.
- Creating accounts on behalf of third parties.
2.2.2. Users must provide accurate, complete, and up-to-date information during registration and whenever updating account details. This includes, but is not limited to:
- Legal name.
- Valid email address.
- Accurate geographic location.
2.2.3. Submission of false, incomplete, or misleading information constitutes a violation of these Terms and may result in:
- Immediate suspension or termination of the account.
- Forfeiture of accumulated points and rewards.
- Reporting of fraudulent activity to appropriate authorities.
2.2.4. The Company reserves the right to monitor, audit, and investigate suspected duplicate or fraudulent accounts. Actions taken against such accounts may include, but are not limited to:
- Suspension or permanent termination of all associated accounts.
- Forfeiture of all points, rewards, and other in-app benefits.
- Permanent banning of the user from future access to the App.
2.2.5. Users are prohibited from using temporary or disposable email addresses, aliases, or other deceptive methods to create or maintain accounts.
2.3. Geographic Restrictions
2.3.1. Access to the App and eligibility for earning or redeeming rewards may be restricted or unavailable in certain geographic regions due to:
- Local legal or regulatory constraints.
- Operational limitations or Company policies.
2.3.2. Users are solely responsible for determining whether access to the App or participation in activities is lawful in their jurisdiction. The Company assumes no liability for violations of local laws caused by user actions.
2.3.3. To enforce geographic restrictions, the Company reserves the right to:
- Implement geo-blocking or IP-based access restrictions.
- Decline registration or terminate accounts originating from restricted regions.
2.3.4. The Company is not obligated to provide notice of geographic restrictions, and users accessing the App from prohibited regions do so at their own risk.
2.3.5. Users found bypassing geographic restrictions (e.g., through VPNs or proxy servers) may face immediate account suspension or termination and forfeiture of accumulated points or rewards.
2.4. Prohibited Entities
2.4.1. Individuals or entities subject to sanctions or restrictions under applicable international, U.S., EU, or local laws are strictly prohibited from using the App or claiming rewards. This includes, but is not limited to:
- Individuals listed on the U.S. Treasury’s Office of Foreign Assets Control (OFAC) sanctions lists.
- Entities subject to trade embargoes or similar restrictions.
2.4.2. Users are solely responsible for ensuring they are not classified as prohibited entities under any applicable laws.
2.4.3. The Company reserves the right to:
- Immediately terminate accounts associated with prohibited entities.
- Withhold rewards pending further investigation.
- Report violations to relevant authorities as required by law.
2.4.4. The Company is not liable for any damages or losses resulting from account termination or reward forfeiture due to prohibited entity status.
2.5. Account Verification and Eligibility for Rewards
2.5.1. To ensure compliance with these Terms and to maintain the integrity of the App, the Company may require users to verify their identity at any time, including retroactively.
2.5.2. Verification measures may include, but are not limited to:
- Submission of government-issued identification (e.g., passport, driver’s license).
- Confirmation of email addresses, phone numbers, or payment methods.
- Verification of device details, IP address, or geographic location.
2.5.3. Users who fail to comply with verification requests or provide false or unverifiable information may face:
- Delayed issuance or forfeiture of points, rewards, or other benefits.
- Temporary suspension or permanent termination of their account.
2.5.4. The Company reserves the right to withhold previously accumulated rewards if verification requirements are not met.
2.5.5. Users acknowledge that verification requirements may vary depending on the nature of the activity, reward, or jurisdictional legal requirements.
2.6. Right to Refuse Service
2.6.1. The Company reserves the right, at its sole discretion and without prior notice, to refuse access to the App or deny rewards to any user for reasons including, but not limited to:
- Violation of these Terms or other Company policies.
- Engagement in fraudulent, suspicious, or prohibited activities.
- Failure to meet eligibility requirements or comply with verification standards.
2.6.2. Decisions to refuse service are final, binding, and not subject to appeal or dispute.
2.6.3. Users whose access is denied or rewards are withheld will not be entitled to any form of compensation or recourse unless explicitly authorized by the Company.
2.6.4. The Company is not obligated to provide justification or reasoning for service refusals.
3. User Accounts
3.1. Registration and Information
3.1.1. Users must provide accurate, truthful, and up-to-date information during registration and whenever updating account details. This includes, but is not limited to:
- Legal name and valid contact information (e.g., email address, phone number).
- Geographic location and country of residence.
- Device details, if required for account verification or compliance purposes.
3.1.2. The Company reserves the right to verify the accuracy and authenticity of any information provided by the User. Verification measures may include, but are not limited to:
- Submission of government-issued identification documents.
- Confirmation of ownership of email addresses, phone numbers, or devices.
- Cross-referencing with third-party databases to validate user details.
3.1.3. The following actions constitute a breach of these Terms and may result in immediate suspension or termination of the account, as well as forfeiture of all accumulated points and rewards:
- Providing false, incomplete, outdated, or misleading information.
- Using disposable, temporary, or anonymous email addresses.
- Impersonating other individuals, entities, or organizations during the registration process.
3.1.4. The Company reserves the right to:
- Suspend or terminate accounts that violate this section.
- Retain account information for investigative or legal purposes, subject to applicable laws.
- Report fraudulent activity or violations to relevant authorities for further action.
3.2. Account Responsibility
3.2.1. Users are solely responsible for safeguarding their account credentials, including but not limited to:
- Usernames, passwords, and two-factor authentication (if enabled).
- Ensuring secure storage and management of credentials to prevent unauthorized access.
3.2.2. Unauthorized access resulting from negligence by the User, such as:
- Sharing login credentials with third parties.
- Using weak or easily guessed passwords.
- Failing to secure devices used to access the App.
The Company will not be held liable for losses or damages, including the loss of points, rewards, or account data.
3.2.3. Users must notify the Company immediately if they suspect:
- Unauthorized access or compromise of their account.
- Misuse of their account or associated activities.
3.2.4. The Company reserves the right to:
- Temporarily suspend access to accounts suspected of being compromised.
- Conduct investigations to determine the cause of unauthorized access.
3.2.5. Users are prohibited from:
- Sharing accounts with others, granting access to third parties, or using shared accounts.
- Selling, leasing, or transferring account access under any circumstances.
3.2.6. The Company is not obligated to restore lost points, rewards, or data resulting from unauthorized access, even if reported after the fact.
3.3. Inactivity Policy
3.3.1. Accounts that remain inactive for 12 consecutive months (i.e., no logins, interactions, or activity within the App) may be deactivated at the sole discretion of the Company.
3.3.2. Upon account deactivation due to inactivity, the following actions may occur without prior notice:
- Forfeiture of Points and Rewards: All accumulated points, rewards, and in-app assets will be permanently forfeited.
- Data Deletion: User account data may be deleted from the Company’s systems unless retention is required by applicable laws or Company policies.
3.3.3. Users are solely responsible for maintaining activity to preserve their accounts and associated rewards.
3.3.4. The Company may notify users of impending deactivation due to inactivity, but is not obligated to do so.
3.3.5. Reactivation of inactive accounts is at the sole discretion of the Company and may be subject to conditions, including verification or fees.
3.4. Multiple Accounts and Prohibited Use
3.4.1. Each User is permitted to create and maintain only one account. The following actions are strictly prohibited:
- Creating multiple accounts for personal use.
- Accessing or maintaining accounts on behalf of others.
- Circumventing account restrictions or suspensions by creating new accounts.
3.4.2. Accounts found to be duplicates or associated with fraudulent activities will be subject to:
- Immediate suspension or termination.
- Forfeiture of all points, rewards, and other benefits.
- Permanent banning of the User from accessing the App in the future.
3.4.3. Users are explicitly prohibited from:
- Selling, transferring, or trading accounts.
- Using third-party services or tools to create, manage, or automate accounts.
3.4.4. The Company reserves the right to use automated systems and manual reviews to detect and enforce compliance with this section.
3.4.5. Users may not use shared devices, proxy servers, or anonymizing tools (e.g., VPNs) to mask their identity or location for the purpose of creating multiple accounts or bypassing restrictions.
3.4.6. Users found in violation of this section may have their activities reported to relevant authorities for further investigation or legal action.
4. Permitted Use
4.1. Authorized Use
4.1.1. The App is designed and provided solely for personal, non-commercial use. Any other use of the App, including but not limited to commercial, automated, or exploitative purposes, is strictly prohibited.
4.1.2. Users must comply with these Terms and all applicable local, national, and international laws and regulations when accessing or using the App.
4.1.3. By using the App, users represent and warrant that they:
- Will not use the App for any purpose other than its intended use.
- Have all necessary permissions and rights to use the App in their jurisdiction.
- Will not take any action that infringes upon the intellectual property rights or operational integrity of the App.
4.1.4. Unauthorized access, including access via modified software, VPNs, or other anonymizing tools designed to bypass restrictions or monitoring, is strictly prohibited.
4.2. Prohibited Activities
Engaging in any of the following activities constitutes a material breach of these Terms and may result in account suspension, termination, forfeiture of points/rewards, or legal action:
4.2.1. Exploitation or Unauthorized Use:
- Exploiting vulnerabilities, bugs, errors, or unintended features within the App or its functionalities for personal or collective gain.
- Accessing the App in a manner that violates these Terms, applicable laws, or the intended operational framework of the App.
4.2.2. Automation and Manipulation:
- Using bots, scripts, automated tools, or any unauthorized third-party software to:some text
- Enhance or manipulate points accumulation, rewards, or account activity.
- Artificially inflate referrals, task completions, or other metrics.
- Employing click farms, paid services, or collaborative groups to manipulate tasks, referrals, or rewards.
4.2.3. Account Misuse:
- Sharing, selling, renting, or transferring accounts or access credentials to third parties.
- Accessing another user's account without explicit authorization, including via credential theft or phishing.
4.2.4. Harmful Activity:
- Uploading, distributing, or deploying viruses, malware, or other harmful technologies that may disrupt the App, its servers, or other users.
- Attempting to hack, reverse-engineer, decrypt, or otherwise tamper with the App’s software, systems, or data.
4.2.5. Prohibited Content:
- Sharing or distributing content within the App or its associated communities that is:some text
- Illegal, defamatory, obscene, or offensive.
- Threatening, harassing, or otherwise harmful to other users or the Company.
- Engaging in spamming, phishing, or any other unsolicited activity within the App or its associated platforms.
4.2.6. Circumvention and Deception:
- Bypassing geographic, technical, or usage restrictions imposed by the Company.
- Engaging in deceptive practices such as impersonation, false identity creation, or unauthorized use of another user’s credentials.
4.3. Monitoring and Enforcement
4.3.1. The Company reserves the right to monitor all user activity within the App to ensure compliance with these Terms and to detect unauthorized, fraudulent, or prohibited activities. Monitoring may include but is not limited to:
- Tracking points accumulation, referrals, and task completions.
- Detecting irregular usage patterns indicative of fraud or manipulation.
- Verifying user actions that impact the integrity of the App.
4.3.2. Users consent to the Company’s use of automated tools, algorithms, and manual reviews to monitor and enforce compliance.
4.3.3. Users found engaging in prohibited activities may face one or more of the following consequences, at the Company’s sole discretion:
- Immediate suspension or permanent termination of their account(s).
- Forfeiture of all points, rewards, and account privileges.
- Reporting of violations to relevant authorities for further investigation or legal action.
- Exclusion from future participation in the App or its associated events.
4.3.4. The Company reserves the right to suspend user activity for investigatory purposes if prohibited activities are suspected, even in the absence of conclusive evidence.
4.4. No Commercial Use
4.4.1. The App and its features are strictly for personal use and may not be used for any commercial purposes. Prohibited commercial activities include but are not limited to:
- Promoting, advertising, or marketing products, services, or organizations within the App.
- Selling, trading, or bartering points, rewards, or access privileges with other users or third parties.
- Using the App to drive traffic to external platforms or services for profit.
4.4.2. Users engaging in unauthorized commercial use may face account suspension, termination, or legal action, as well as forfeiture of accumulated points and rewards.
4.5. Reservation of Rights
4.5.1. The Company reserves the right to refuse service, restrict access, or terminate accounts at its sole discretion if prohibited activities are detected, suspected, or reported.
4.5.2. The Company’s decision to take action based on suspected violations does not require concrete or definitive evidence and is not subject to appeal.
4.5.3. The Company is not obligated to provide notice or explanation when refusing service, restricting access, or terminating accounts.
4.5.4. Users agree that their sole remedy in cases of service refusal or restriction is to discontinue use of the App.
5. Earning Points and Rewards
5.1. Points System
5.1.1. Users can earn points by participating in various activities within the App, including but not limited to:
- Tapping within the App.
- Completing assigned tasks.
- Referring new users.
- Playing in-app games or participating in challenges.
5.1.2. The points system, earning mechanisms, rates, and associated activities are subject to change at any time without prior notice and at the sole discretion of the Company. Changes may include:
- Adjusting the points awarded for specific activities.
- Adding, modifying, or removing eligible activities.
- Introducing time-limited or event-specific earning opportunities.
5.1.3. The Company reserves the right to adjust, cancel, or remove points earned under any of the following circumstances:
- Errors or Discrepancies: Points awarded due to technical errors, miscalculations, or system malfunctions.
- Violation of Terms: Points earned in violation of these Terms or through activities that breach the rules.
- Fraudulent Activity: Detection of suspicious or prohibited activities, including manipulation or exploitation of the App’s systems.
5.1.4. Users acknowledge that points have no monetary value and cannot be redeemed or exchanged for cash unless explicitly stated by the Company.
5.2. Rewards
5.2.1. Points accumulated through the App can be redeemed for various rewards, which may include:
- Moonfame Tiers: Providing access to premium features, exclusive benefits, or other in-app advantages.
- Cryptocurrency Rewards: Subject to the conditions and limitations outlined in Section 5.5.
5.2.2. Redeeming points for rewards is contingent upon the User’s full compliance with these Terms and any additional conditions or criteria specified for the rewards.
5.2.3. Rewards are offered on an “as available” basis and are subject to change or discontinuation at the sole discretion of the Company. Availability may be affected by:
- Operational limitations.
- Inventory or resource constraints.
- Changes to the App’s reward system.
5.2.4. The Company does not guarantee the availability of any specific reward at any given time and assumes no liability for discontinued or unavailable rewards.
5.3. Conditions for Rewards
5.3.1. Rewards, including but not limited to Moonfame Tiers and cryptocurrency, are subject to the following mandatory conditions:
Compliance Verification:
- Users must comply with all App rules, anti-fraud measures, and task-specific requirements. Failure to comply may result in forfeiture of points or rewards.
Task Completion:
- Rewards tied to tasks or milestones will only be issued upon verification of successful and complete task completion. Partial or insufficient completion does not entitle the User to a reward.
Account Verification:
- Users may be required to complete verification processes, such as:some text
- Submission of government-issued identification documents.
- Confirmation of email addresses, phone numbers, or device details.
- Failure to complete verification or submission of false information may result in forfeiture of associated points or rewards.
5.3.2. Rewards are non-transferable, non-refundable, and non-exchangeable for cash or other equivalents unless explicitly stated by the Company.
5.4. Right to Withhold Rewards
5.4.1. The Company retains full discretion to withhold, revoke, or cancel rewards for any of the following reasons:
- Fraudulent Activities: Including, but not limited to, fake referrals, bot usage, or task manipulation.
- Violation of Terms: Breaching App rules, event-specific terms, or milestone conditions.
- Suspicious Behavior: Actions requiring investigation or clarification, even without definitive proof.
- Operational Necessities: System errors, maintenance, or factors beyond the Company’s control.
5.4.2. Users whose rewards are withheld or revoked are not entitled to compensation or recourse unless explicitly authorized by the Company.
5.4.3. The Company reserves the right to temporarily or permanently withhold rewards pending completion of investigations into suspicious activities.
5.5. Crypto Rewards
5.5.1. Cryptocurrency rewards are primarily distributed in USDT or other cryptocurrencies determined by the Company.
5.5.2. Alternative cryptocurrency payouts will reflect their equivalent value in USDT at the time of transfer, inclusive of transaction fees.
5.5.3. The Company is not liable for:
- Fluctuations in cryptocurrency value before, during, or after the transfer.
- Delays in cryptocurrency distribution caused by network congestion, technical failures, or unforeseen circumstances.
- Losses or inaccessibility resulting from User errors, such as:some text
- Providing incorrect wallet addresses.
- Using incompatible wallets.
5.5.4. Users are responsible for ensuring compliance with local regulations regarding cryptocurrency rewards, including taxation and reporting obligations.
5.5.5. The Company reserves the right to implement additional conditions or restrictions for cryptocurrency payouts, including minimum payout thresholds or geographic limitations.
5.6. Non-Cash Rewards
5.6.1. Non-cash rewards, such as Moonfame Tiers or exclusive access, are contingent upon:
- Successful and verified completion of tasks or milestones.
- Compliance with all conditions and terms specified for the reward.
- Verification of eligibility and absence of prohibited activities.
5.6.2. Non-cash rewards are provided “as is” and may be subject to change or discontinuation without notice.
5.6.3. The Company does not guarantee the usability or functionality of non-cash rewards outside the App.
5.7. Event-Based Rewards
5.7.1. Rewards tied to special events (e.g., Referral Day bonuses) are governed by event-specific terms and conditions, which will be published prior to the event.
5.7.2. Participation in an event does not guarantee eligibility for rewards. Eligibility is contingent upon compliance with event rules and criteria.
5.7.3. The Company reserves the right to:
- Modify, delay, or cancel event-based rewards without prior notice.
- Disqualify participants who violate event-specific rules or these Terms.
6. Fraud, Misuse, and Violations
6.1. Prohibited Activities
Engaging in fraudulent or prohibited activities constitutes a material breach of these Terms and may result in immediate consequences as outlined in Section 6.2. Prohibited activities include but are not limited to:
6.1.1. Bot and Automation Use:
- Employing scripts, bots, click farms, or automated tools to artificially inflate activity, manipulate points, or earn rewards.
- Using unauthorized third-party software, extensions, or modifications to interact with the App.
6.1.2. Fake Accounts or Referrals:
- Creating multiple accounts for personal use or to manipulate referral-based rewards.
- Referring fake users or engaging in deceptive practices to exploit referral systems.
6.1.3. Task Manipulation:
- Exploiting system vulnerabilities, glitches, or errors to gain an unfair advantage.
- Submitting incomplete or falsified task completions to claim rewards.
- Circumventing or bypassing task-specific requirements or restrictions.
6.1.4. Data Tampering and System Exploitation:
- Altering, intercepting, or injecting malicious code into the App’s data, software, or systems.
- Attempting to reverse-engineer, hack, or otherwise compromise the App’s infrastructure.
6.1.5. Unauthorized Access:
- Accessing or attempting to access another user’s account or private information without explicit authorization.
- Using stolen, shared, or otherwise unauthorized credentials to gain access to the App.
6.1.6. Content Abuse:
- Uploading, distributing, or promoting harmful content, including but not limited to:some text
- Viruses, malware, or other malicious software.
- Offensive, defamatory, illegal, or otherwise harmful material.
- Spamming, phishing, or engaging in other disruptive activities within the App or associated platforms.
6.1.7. Circumvention of Restrictions:
- Using VPNs, proxy servers, or anonymizing tools to bypass geographic or technical restrictions imposed by the Company.
- Engaging in deceptive practices to evade detection or enforcement mechanisms.
6.2. Consequences for Violations
6.2.1. Users found to be engaging in fraudulent or prohibited activities may face one or more of the following consequences, at the Company’s sole discretion:
- Immediate Suspension or Termination: Permanent or temporary suspension of user accounts, with or without prior notice.
- Forfeiture of Points and Rewards: Loss of all accumulated points, pending rewards, and access to in-app benefits.
- Exclusion from Future Activities: Ban from participating in future rewards, events, tasks, or App functionalities.
- Reporting to Authorities: Referral of the violation to relevant authorities, including but not limited to law enforcement or regulatory bodies, for further investigation or legal action.
6.2.2. Consequences imposed are final and binding, and the Company is not obligated to provide evidence or justification to the User.
6.3. Investigation and Monitoring
6.3.1. Monitoring Activity:
- The Company reserves the right to monitor all user activity within the App, including but not limited to:some text
- Points accumulation and usage.
- Task completions and referral behavior.
- Logins, session details, and device information.
